Privacy Policy
Pluxee Israel Ltd. company, Company Registration Number 51-276870-6 (the "Company"), which manages and operates the cibus.pluxee.co.il/consumers.pluxee.co.il website (the "Website") and the Cibus Pluxee app (the "App"), respects the privacy of Users of the Website and App and will act in accordance with the Privacy Policy specified below and in accordance with the provisions of any law.
This Privacy Policy is part of the Terms of Use of the Website and App, available at cibus.pluxee.co.il. Unless otherwise defined, the terms defined in the Terms of Use shall have the same meaning as described in the Terms of Use.
1. Processing of personal information on behalf of the Employer
The Company uses the personal information of Users of the Website and App in accordance with the Employer's instructions, as set forth under the service agreement between the Employer and the Company and/or as may be communicated by the Employer from time to time, all for the purpose of providing services to the Users. In accordance with the provisions of the Israeli Protection of Privacy Law, 5741-1981 (hereinafter: the “Protection of Privacy Law”), the Employer serves as the controller of the database in which the Users’ personal information is held, while the Company serves as the processor of the database and manages personal information on behalf of the Employer
Our full Privacy Policy is designed to provide a broad picture of the personal information we manage as the processor of the Employer's database.
Your personal information will be stored in the Employer’s databases, subject to the Employer’s applicable privacy policies. For inquiries or questions regarding the personal information collected and processed by your Employer or on its behalf, please contact the Employer through the standard communication channels available at your workplace. Nothing in this Privacy Policy shall derogate from or override any other privacy-related policies or documents issued by the Employer.
2. Information we collect
In general, the purpose of collecting the [personal] information is to provide the Services described in the Terms of Use of the Website and App, and to improve the [quality of] Service.
2.1 As part of using the Website and App or registering for the Services offered therein, the Company will collect various information about you, including name, email address, telephone number, private address, work address, address for the purpose of deliveries you will order, and more identifying information, as may be required from time to time. The information will be provided to the Company by your Employer and/or by you directly. It should be stressed that you are not obligated by law to provide this information to the Company, and the information is and will be provided of your full will and consent by approving this policy. Unless you give your consent to collect the information as stated in this policy, we will not be able to provide you with all or most of the Services.
***It is clarified that the Company does not hold and/or retain ID number and/or the User's credit card details, but rather the User enters it directly for clearing through a designated company, "Tranzila Clearing and Payment Solutions" for now, through a designated link. Therefore, it is clarified that the Company is not exposed to the entering of the credit card information and ID number of the User.
2.2 In addition, when using the Website and App, information may be accumulated, and we may receive information from third parties, about your practices, the manner you use the Website and App, your IP address, your location, Businesses you ate at, products and Services you purchased, information or advertisements you read on the Website and/or App, pages you viewed, offers you found interesting, methods of payment used by you and more, all for the purpose of providing the Services.
3. Use of information
3.1 Use of such information will be made only in accordance with this Privacy Policy, subject to the law provisions applicable in this context, thus for the purposes set forth below: (a) to operate and manage the Website and App and the Services offered therein, including ancillary services such as technical support and customer service; (b) to provide you with Services and keep in touch with you; (c) to improve and enrich the Services and create new Services and Contents that meet the requirements and expectations of the Users, as well as to modify or cancel existing Services, including through analysis of Big Data and AI models ; d) to send operational messages and alerts to Users via various digital means, including but not limited to email, SMS, push notifications and similar channels, in connection with the provision of the Services, including for authentication and password recovery, responding to surveys, performing actions and confirming execution, and similar purposes; (e) to transmit various types of content, including marketing offers and promotional materials on behalf of the Company or its business partners, via any communication channel, including but not limited to email, SMS, instant messages, phone calls, push notifications, and similar means, subject to applicable law and with the ability to unsubscribe at any time; (f) to detect and prevent viruses, unauthorized use of the Website and App, fraud, or any other violation of the Terms of Use; (g) to comply with any applicable law, including for the purposes of legal proceedings, orders, including disclosure orders, or requests from governmental, regulatory and/or any other competent authorities, as required or permitted by law; h) to adapt to your areas of interest ads that will be displayed to you when using the Website and App or other websites; and (i) for any other purpose specified in the Terms of Use or this Privacy Policy.
For the avoidance of doubt, the provisions of this Privacy Policy shall apply solely to personal information, as defined under the Israeli Protection of Privacy Law. To the extent that any information is collected about Users in a manner that does not identify them and constitutes non-identifiable or aggregated data, the Company shall be entitled to use such information for any purpose without limitation.
4. Disclosure of information to third parties
4.1 The safety of your personal information is important to us. We act according to the standards set by law and in accordance with and subject to the protection of privacy laws and the applicable legal provisions in this context, in order to protect the personal information that you have submitted to us, both at the stage of delivery and from the moment it is received.
4.2 Details and information about you will not be disclosed to third parties without your prior consent, except to the extent permitted under this Privacy Policy. Notwithstanding the foregoing, the Company may disclose your personal information and information collected about you to third parties in the following cases: (a) for the purpose of providing the Services by the Company and/or to service providers of the Company, including Restaurants under Agreement and/or Businesses under agreement, cloud service providers and/or information recipients outside Israel, including in countries that do not provide protection similar to that provided by the State of Israel, in order for the Company to store and/or process the information and provide you with the Services, including in accordance with the purposes specified in this Privacy Policy; b) in the event that you violate the Terms of Use of the Website and App and/or this Privacy Policy, or perform through the Website and/or App, or in connection thereto, illegal actions or an attempt to take such actions; (c) if the Company receives a judicial order instructing it to provide a third party with your information or details about you; d) in the event that the Company believes that disclosing the information is necessary to prevent serious damage to the Company, to your body or property or to the body or property of another; (e) if it is statistical information about the use of the Website and/or App, which does not identify you personally; (f) in the event of a sale of the Company's shares or most of its assets, insofar as the disclosure of information is necessary for the execution of such a transaction, including during business negotiations, and in the event of an assignment of the Company’s operations, rights, or obligations toward the Users to a third party, provided that such third parties undertake to comply with the provisions of this Privacy Policy; and (g) in any case where the information is disclosed to corporations affiliated with the Company, including corporations that hold ownership interests in the Company, for purposes of ongoing supervision, management, and operations.
5. Use of Cookies and third-party monitoring and tracking tools
5.1 The Website and App use automatic tools and data collection technologies known as Cookies for their ongoing and proper operation, inclusively aiming to collect statistical data about the use of the Website and App, to verify details, to adapt the Website and App to your personal preferences and for information security purposes. Cookies, in general, are text files and tiny graphic images your browser or platform create according to a command. Some Cookies will expire when you close your browser or App, and others are stored on the device memory or your computer's hard drive. 5.3 The Website and App use Cookies of third parties, for the purposes of activity analysis and advertising within the scope of providing the Services. Such Services are provided by third parties, and the Company bears no liability for them. To the extent that Users wish to learn about the use made by such companies of tracking technologies and the data collected through them, they may do so via the following links:

5.4 In addition, the Website uses third-party software (Hotjar), which monitors User behavior and records information, inter alia in order to track your patterns of activity on the Website and App, improve the Services and offer you Contents you may find interesting, as well as the Zoom Analytics add-on designated to present useful information and updates on the Service. It is clarified that the information collected through this monitoring and tracking tool is statistical in nature and there is no monitoring and/or recording of your Personally Identifiable Information and/or credit card information.
6. Other platforms
The Website and App may include links to various online pages, apps, and websites that are not managed and/or operated by the Company and/or anyone on its behalf. It is stressed that any such third-party website may collect your personal information and use it differently from the Company. The Company does not control and/or supervise such pages, apps, and websites. The use of these pages, apps, and websites is subject to the Privacy Policy displayed therein, rather than to the Privacy Policy of the Company, and therefore the Company bears no liability for any action related to the information collected on these websites.
7. Information security
The Company uses information security systems to prevent unauthorized access to information in its possession. However, the Company cannot guarantee that the Website and Services will be completely immune to unauthorized access to information stored by it and, subject to the provisions of any law, will bear no liability for any damage caused due to hacking of information held by it.
8. Promotional mailing and direct mailing
We are expected to send you, from time to time, marketing notices and offers, including direct mailing messages (as this term is defined in the Protection of Privacy Law) in connection with the provision of Services on behalf of the Employer. You may hereby cancel your consent to receive promotional mailing and/or direct mailing by contacting the Company in all ways prescribed by law, inter alia in the same manner the mailing was delivered to you (including by clicking the "unsubscribe" link at the bottom of the email you received), by giving a written notice to the Company, by changing the settings menu on the Website and/or App, by changing the settings on your cellphone and/or through the User settings in the App. With regard to push notifications in the App, it is clarified that unsubscribing you from promotional mailing services and/or or direct mailing actions and removing you from the mailing list, will not delete the information collected about you by the Company in accordance with the Employer's instructions, and the Company or anyone acting on its behalf will be entitled to continue using this information in accordance with the purposes specified in this Privacy Policy.
Unsubscribing you from the mailing list for promotional mailing and direct mailing messages will be made within 48 hours from the date of receiving your request to withdraw your consent to receive promotional/direct mailing, using the methods described above.
9. The right to access and/or correct and/or delete information
Pursuant to the Protection of Privacy Law, you are entitled to contact your Employer to request access to your personal information held in your Employer’s database. Furthermore, if you find that the personal information concerning you is incorrect, incomplete, unclear, or outdated, you may request your Employer to correct or delete it, subject to the Employer’s policy and applicable legal provisions. If you choose to submit a request to the Company for access or correction of your information, we will forward your request to your Employer and act in accordance with their instructions, subject to the provisions of the law.
10. Changes in the Privacy Policy
The Company may, from time to time, amend the provisions of this Privacy Policy, including in light of changes in applicable laws. If any material changes are made to the provisions of this Policy concerning the use of the personal information you have provided, a notice will be posted on the homepage of the Website.
